Passed as an emergency measure on the final day of the 2026 session and signed by Governor Wes Moore on May 31, 2026, the Community Trust Act bars state and local correctional facilities from honoring ICE detainer requests, providing advance notice of an individual’s release, or transferring people to ICE custody without a valid judicial warrant or court order.
