Signed by Gov. Moore on May 12, 2026 and taking effect Oct. 1, 2026, the No Kings Act creates a state civil cause of action allowing Marylanders or the Maryland Attorney General to sue federal officials, including masked or unidentified immigration agents, who violate someone’s constitutional rights ‘under color of law,’ and authorizes use of surveillance data (e.g., cellphone or GPS data) to help identify agents named in misconduct claims. The bill followed a year of high-profile confrontations between ICE agents and civilians nationally, including the fatal shootings of two U.S. citizens by federal agents in Minneapolis, which supporters cited as motivation for the legislation.
